Comprised of "The Rains" 7"EP (Deathwish 2002) , "The Blues" 7"EP (Deathwish 2003), as well as their Demo sessions (2001) and brand new material, "All My Friends Are Going Death" has been remixed and remastered by Paul Miner (Death By Stereo). SOME GIRLS have managed to excite the hardcore/punk world with the release of very little material, and just a few intense live performances. This may have something to do with the band being comprised of a cast of members that includes Wes Eisold (Give Up The Ghost/AN), Rob Moran (Unbroken, Over My Dead Body), and Justin Pearson (The Locust, Swing Kids) among their collective line-up.

SPINAL CORD's 'Remedy' To See American Distribution

12.09.03 (RockAndMetal.com) Poland Death/Thrash Metallers SPINAL CORD will see the Americans release of their new Empire Records album, "Remedy," through distribution via Crash Music Inc. in February. SPINAL CORD originates from the town of Busko Zdroj and started playing as a unit in August 1999. In April 2000, the band began work on their 3-track promotional demo "A.D.2000" in Lublin's Hendrix Studio. At the same time, SPINAL CORD was given the opportunity to play their first big concert on "Behemoth's Millenium Tour 2000" that year. The band has also backed VADER and BEHEMOTH at gigs in Poland in the recent past. "Remedy" was recorded at Screw Factory Studios in Debicy and produced by Janusz Bryt -- the first of a 3-album deal signed with Empire Records at the beginning of this year.

12.09.03 (RockAndMetal.com) TOM PETTY & THE HEARTBREAKERS have earned their first Recording Industry Association Of America (RIAA) "Diamond" award for their 1993 MCA Records compilation "Greatest Hits." The set was certified in November for U.S. shipments of 10 million copies. Through a career that saw them inducted into The Rock And Roll Hall Of Fame in 2002, TOM PETTY & THE HEARTBREAKERS have shipped more than 28 million copies of their albums in the U.S., according to the RIAA's accounting. November also saw recently reunited duo Simon & Garfunkel and classic rock stalwarts Boston reach a new milestone. Boston's self-titled 1976 Epic Records debut was certified for shipments of 17 million copies, while 1972's "Simon & Garfunkel's Greatest Hits" (Columbia) notched the 14 million mark.

12.09.03 (AP) OZZY OSBOURNE was seriously injured Monday in an accident on the grounds of his estate in England and underwent emergency surgery, a spokeswoman said. The 55-year-old rock star was riding a "quad bike," or all-terrain vehicle, on his Buckinghamshire property when the accident occurred, according to publicist Cindy Guagenti. His injuries were not considered to be life-threatening, she said. An examination showed Osbourne broke his collarbone, six ribs and a vertebra in his neck, according to Guagenti. He was in surgery Monday evening at an undisclosed English hospital. The operation was intended to lift the collarbone, which was believed to be resting on a major artery and interrupting blood flow to his arm. Conceived as a single from the forthcoming album, "Here Comes That Weird Chill..." was expanded with the inclusion of outtakes from the album sessions (the 'Extras and Oddities' part). One such 'oddity' is a cover of Captain Beefheart's 'Clear Spot,' and the new song 'Skeletal History,' which was written by Lanegan and Queens Of The Stone Age band mates Josh Homme and Nick Oliveri.

The clip was shot "on a Navy aircraft carrier named the U.S.S. Hornet, which has a very long history for shooting down more planes and disabling more ships than any other military fighter in U.S. history," EXODUS manager Steven Warner told Blabbermouth.net. "It also has been very well documented as being haunted. There have been numerous programs on the Discovery Channel and the History Channel regarding the paranormal that's been going on [there] for several years. 'War Is My Shepherd' comes off EXODUS' upcoming studio album, "Tempo Of The Damned," due to be released in Europe on February 2nd by Nuclear Blast Records. Federal Judge Approves Settlement Against CD Music Clubs
12.09.03 (Reuters) A federal judge has approved a settlement that gives discount vouchers to more than 8 million members of various music clubs who had accused record groups of conspiring to fix CD prices. The settlement, approved by U.S. District Judge D. Brock Hornby in Portland, Maine, calls for immediate mailing of vouchers providing for 75 percent discounts on regular CD club prices. The class action lawsuit was filed several years ago against Bertelsmann AG's BMG Music Club, Columbia House and several other CD manufacturers and distributors, alleging they conspired to set prices of CDs sold to music club members. His "A Reality" tour was scheduled to begin on Saturday in Atlantic City, N.J., and continue to Washington, D.C. the next day. Those shows will be rescheduled. The tour is now expected to kick off in Boston tomorrow at the Fleet Center. Bowie, 56, received a Grammy nomination on Thursday for a track off his current album "Reality," which spent just four weeks on the U.S. pop charts. The just-finished European leg of his tour received wide critical acclaim, as he dug deep into his back catalog to play some rarely performed songs from the past.

XYSTUS' 'Receiving Tomorrow' Debut Due In Early 2004

12.08.03 (RockAndMetal.com) Dutch Progressive Metal band XYSTUS will finally be releasing their long-awaited debut album, "Receiving Tomorrow," through DVS Records in Early 2004. XYSTUS, a young band who recently signed with DVS, played this year's ProgPower Europe 2003 festival to some strong reviews, as well as at the recent Metal Bas XL. XYSTUS was formed in 1999 by Bas Dolmans (guitar and vocals) and Ivo van Dijk (drums). Tim van Dijk (ex-bass) and Pim van Drunen (ex-synths) were then recruited to complete the original line-up of the band. In their relatively short existence, XYSTUS has recorded 3 demos and played well over 100 live gigs. "Receiving Tomorrow" was produced by Rob van Boeckel, with artwork created by Niall Parkinson, a graphic designer from Ireland.

Peer-To-Peer Network Group Floats Plan To Pay For Music
12.08.03 (Reuters) Internet users who copy music through "peer-to-peer" networks should pay a flat fee to compensate musicians and record labels whose songs they download, a technology trade group has proposed. The proposal by the Distributed Computing Industry Association is intended to nudge the popular peer-to-peer networks toward respectability, and forge peace with the record labels that have hounded them and their users in court. Under the proposal, peer-to-peer users would pay a flat monthly fee to the networks or to Internet service providers, which would be divided up among the record labels and musicians whose songs were downloaded. 12.05.03 (AP/RockAndMetal.com) A Manhattan judge has ordered the eviction of the BOTTOM LINE nightclub from the Greenwich Village space it has occupied for the past 30 years. Civil Court Judge Donna Recant found that the club, which had no lease and admittedly owed more than $190,000 in back rent, must relinquish it's space to it's landlord, New York University. The judge stayed the eviction for five days. The music mecca's lawyer, Mark Alonso, said Wednesday that he expected the ruling. "But the thing that's the most galling to me is that NYU was saying they weren't suing for eviction," Alonso said. "They just didn't want us there." Reportedly, the album kicks off where "Soulskinner" ended, but promising a lot more intensity, variety, and deadliness. FLESHCRAWL was formed under the original names of MORGOTH and SUFFOCATION in 1987. They released their first 7" EP, "Lost In A Grave," in 1991 on Morbid Records. FLESHCRAWL's second album, "Impurity," was released in 1993, and was produced at Dan Swano's Unisound Studios. Their third album, "Bloodsoul," was issued in 1995, followed by "Bloodred Massacre" in 1997. "Fans Only" is a record of the development of BELLE & SEBASTIAN during their time with Jeepster, from "...Sinister" to "Storytelling." Featuring all the duo's videos, live performances, interviews, out-takes, TV appearances, early documentary footage, exclusive material and behind-the-scenes insights into the evolution of the band, it has been released and is currently available in PAL format. "Fans Only" was compiled by Glasgow-based film maker Blair Young and BELLE & SEBASTIAN over a period of 8 months. The Matador edition of the DVD will be regionally encoded for region 1 NTSC, and Toshiba EMI will release the DVD in Japan encoded for region 2 NTSC.

RIAA Files 41 Additional Lawsuits Against Music File Sharers

12.05.03 (Reuters) The Recording Industry of America has filed 41 new lawsuits against Internet users who trade songs online, saying the legal campaign was producing a growing number of settlements and drawing greater public support. The trade group filed its third wave of lawsuits since September in federal courts across the United States, targeting users who each uploaded about 1,000 copyrighted music files on peer-to-peer networks, a spokesman said. The RIAA planned to warn another 90 users that they may be sued, the spokesman said. Under copyright law, each defendant can be held liable for $750 to $150,000 in damages if the lawsuit is successful. The RIAA said it had reached monetary settlements with 220 Internet users it had accused of illegally copying and distributing music online through peer-to-peer networks such as... [full story]

Band member Jaret Von Erich comments: "We were all still working day jobs, and pretty much NO ONE knew who our band was, even locally. We saved every penny from shows and t-shirt sales, and recorded it as cheaply as possible. It was our first time working with our producer Eric Delegard, and he was still learning as well... We recorded over a period of months in the summer of '96. It was then that we met up with FFROE, who agreed to put the album on his local label, and who would eventually become our manager, and my business partner. This album was basically the start of BOWLING FOR SOUP being a full-time band."

RAY CHARLES Recovering After Replacement Surgery

12.04.03 (AP) Singer RAY CHARLES is recovering in his Beverly Hills home after undergoing a hip replacement last week. "I feel terrific, and am so thankful to the good Lord that all is going well for me," Charles says. "I can't wait to get back on the road, which is my second home." Discomfort in his left hip forced the 73-year-old singer to cancel his remaining 2003 tour dates -- the first time Charles had canceled a tour in 53 years. Charles is also undergoing physical therapy, and expects to start a national tour again in March. While hospitalized in November, Charles donated $1 million to Dillard University in New Orleans, and has been working on a duets album at his private studio. Charles has won 13 Grammy Awards, and was one of the original inductees into The Rock And Roll Hall Of Fame in 1986.

DESTINITY is also preparing a Spring tour with label mates BENIGHTED and a headlining European band. "In Ecxelsis Dementia" will contain 10 tracks of Extreme Metal, with both heavy Black and Death influences, and is scheduled to be released in March of 2004. The first 500 copies will be a hand-numbered limited edition digi-pack. DESTINITY formed in Lyon, France in 1996, and released the demo tape "Enigmatic Forest." Their debut full-length album, "Wepts From The Sky," was released in 1999, followed up by 2001's "Supreme Domination's Art" and this year's "Under The Smell Of Chaos."

In addition, both front man Scott Stapp and guitarist Mark Tremonti are working on solo albums that are being targeted for release next year. Manson (whose real name is Brian Warner) and his band members take their first names from pop culture icons and their surnames from famous serial killers. 12.04.03 (AP) The recording industry has filed 41 more lawsuits against computer users in at least 11 states it said were caught illegally distributing songs over the Internet, continuing its aggressive campaign against online music piracy. The latest copyright suits this week bring to 382 filed since the Washington-based Recording Industry Association Of America announced it's legal campaign nearly six months ago. The group's president, Cary Sherman, said the group has no plans to cut back, even as media coverage over the continuing lawsuits wanes. "People who engage in illegal file-sharing should be aware, whether or not they hear about it this month, that doesn't mean the enforcement program has been reduced in any way," Sherman said. "If anything it will be increased." The recording industry is monitoring popular Internet services where computer users can download song files, searching for people illegally distributing the largest music collections. Court-issued subpoenas compel Internet providers to identify their customers linked to the online accounts used to download songs. The new 3-CD/2-DVD set contains material up to and including the self-titled "Black" album, including concert favorites 'Creeping Death' and 'Seek & Destroy,' as well as classics like 'For Whom The Bell Tolls,' 'Welcome Home (Sanitarium),' and 'Fade To Black.' There are also a couple of ripping-fast solos from Jason Newsted and Kirk Hammett, plus covers of 'Last Caress,' 'Am I Evil?' and 'Stone Cold Crazy.' The videos are from a 1992 San Diego concert, and a 1989 stop on the "Damaged Justice" tour in Seattle. "Live Sh*t: Binge & Purge" is actually a re-release of the original VHS box set, which was first issued on November 23rd, 1993. The original 72-page, full-color booklet is now on DVD, and a new commemorative backstage pass and a "scary guy" stencil are also included.
